Send the demand letter immediately. If unpaid after 7 days, serve the suspension notice. If still unpaid, refer to adjudication — decisions in as few as 14 days.

What is a Pay Less Notice?

Under the Housing Grants, Construction and Regeneration Act 1996, a contractor must serve a formal written Pay Less Notice before they can legally pay you less than what you applied for.

This notice must be served before a specific deadline — typically 5 days before the final date for payment. It must state the amount they intend to pay and the basis for any deduction.

If they didn't serve a valid Pay Less Notice — the full amount is legally due.

This applies to both final payments and retention releases.
